Appellees decedent, Frank McCarty, by will created a trust for the benefit of his son. He also provided that on the termination of the trust, the funds then remaining were to be used to erect and construct a mausoleum as a final resting place for his remains and he remains of others of his family. Appellant, the personal representative of the sons estate, brought suit seeking a resulting trust on the alleged invalidity of the testamentary provisions.
